Traffic stops lead to felony charges for Libby man

A Libby man is facing several charges following a pair of traffic stops earlier this year.
Jacob L. Volkenand, 42, pleaded not guilty Oct. 20 in Lincoln County District Court to two felony counts of possessing dangerous drugs and numerous misdemeanors, including driving without insurance, driving on a suspended license and displaying a license plate assigned to another vehicle.
Volkenand, who is not in custody, is scheduled to appear Nov. 17 in district court.
According to the probable cause statement by county deputy Andrew Smith, he stopped a black Honda S2000 in Libby on Aug. 28 for not displaying plates that should have been on the car.
Two days later, the deputy saw the vehicle again and recognized Volkenand as the driver. When he followed the car, he saw the passenger’s side brake light was not working.
When he stopped the vehicle, he asked Volkenand for proof of insurance, but the man said he didn’t have coverage on the car. When the deputy ran a records check, he learned a different plate was supposed to be on the car.
A records check with a dispatcher determined Volkenand had seven prior convictions for driving on a suspended license.
After arresting him, deputy Smith searched him and reported finding a clear plastic bag with a white, crystal-like substance in it. A field test determined it was positive for methamphetamine.
A search of the vehicle allegedly turned up a loaded syringe. A field test was positive for meth. Inside a backpack, the deputy reported finding what he believed were psilocybin mushrooms and a spoon with a white substance on it.
At the county jail, a search of Volkenand turned up a yellow cough drop bag with a white, crystal-like substance in it. A field test indicated it was meth.
A conviction for felony possession of dangerous drugs may result in a 5-year term in the Montana State Prison. Convictions for possessing drug paraphernalia and driving on a suspended license may result in six-month county jail terms. Convictions on the others may result in fines ranging from $100 to $500.
