Coeur d’Alene man charged with lewd conduct has bail set at $150,000

A Coeur d’Alene real estate agent was arrested Wednesday, Nov. 12, in Kootenai County for alleged sexual abuse stemming from a 2013 incident in Boundary County.
Scott Dustin Smith, 48, was arrested Nov. 12 in Kootenai County on allegations of lewd conduct with a minor under the age of 16, according to a criminal complaint.
According to the Boundary County Sheriff’s Office, Smith has been booked into the Kootenai County Jail and is awaiting transfer to Boundary County.
During an initial hearing Nov. 17, Smith, appearing via Zoom from jail, shared that he and his family are seeking legal counsel for the case. At this time, his current bail is set at $150,000 despite Boundary County Prosecutor Andrakay Pluid's request to set bail to $500,000 for fear of Smith being a flight risk and having significant assets.
The Hayden real estate official was arrested at his office Wednesday, Nov. 12, according to the Kootenai County Sheriff inmate list.
BCSO officials said Smith was arrested as a result of an ongoing investigation into allegations of inappropriate conduct involving a minor.
The arrest was made by BCSO detectives Brandon Blackmore and Nick Delavan in collaboration with the United States Marshals Service Fugitive Task Force.
BCSO investigators said there may be additional victims and encouraged them to come forward.
To protect the privacy and integrity of the case, BSCO officials said no further information is being provided at this time.
