CITY OF OSBURN, IDAHO ORDINANCE NO. 308 AN ORDINANCE OF THE CITY OF OSBURN, SHOSHONE COUNTY, STATE OF IDAHO, AMENDING CHAPTER 6, ARTICLE IV OF THE OSBURN MUNICIPAL CODE (CHICKENS) TO ADD SECTIONS 6-94 AND 6-95 RELATING TO THE DISPOSITION OF UNCLAIMED OR INFECTED CHICKENS AND REQUIRING A PERMIT TO KEEP CHICKENS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF OSBURN, SHOSHONE COUNTY, STATE OF IDAHO as follows: Section 1. Any at-large or off-premises chicken apprehended and impounded as provided in this article shall be held for forty-eight (48) hours by City animal control officials or their appointees. If, at the expiration of forty-eight (48) hours from the date of notice to the owner or the posting of notice, such chicken has not been claimed or redeemed, it may either be destroyed or sold to any citizen for any lawful use or purpose, with no subsequent liability inuring to the City from any party, owner, former owner, or subsequent purchaser. Any unclaimed or unredeemed chicken, or any chicken which appears to be suffering from or infected with mites, roundworms, tapeworms, Coccidia, or other parasites; viral infections such as Avian Influenza, Newcastle Disease, Infectious Bronchitis, Marek’s Disease, or Fowl Pox; or bacterial diseases such as Fowl Cholera, Salmonella, Escherichia coli, or Mycoplasmosis; or found to be injured, may not be released but may be destroyed and safely disposed of. Costs may be assessed to the owner(s), if known or later ascertained, pursuant to section 6-92(3).” Section 2. Ordinance 302, Chapter 6 (Animals), Article IV (Chickens) of the Osburn Municipal Code is hereby amended by adding a new section, Sec. 6-95, to read as follows: “Sec. 6-95. – Permit required to keep, possess, or maintain chickens within city limits. a) Permit required; fees; term. A permit obtained from the City is required before keeping, possessing, or maintaining chickens on any property within the city limits. The fee for the permit, and the annual renewal fee, shall be as set by the City Council by resolution. Permitting fees shall be reasonable and shall not represent an unduly burdensome expense for applicants. b) Application. Each application shall be in writing, signed by the applicant, and shall include, at a minimum, the name and address of the applicant and such further information as may be required by the City to ensure compliance with this article. If the applicant is not the property owner of record, written approval of the property owner of record shall be submitted with the application. c) Inspection authority. Submission of an application and/or issuance of a permit under this section authorizes the City, upon complaint or on its own initiative, to enter and inspect the premises upon which chickens are kept to ascertain compliance with this article and applicable codes and ordinances. d) Issuance standard. Permits shall not be unduly withheld from applicants who complete the application process, pay the established fee, and demonstrate compliance with this article and all applicable codes and ordinances of the City. e) Display; production on request. Permits shall be kept in a conspicuous place on the premises and produced to law enforcement or other City officials upon request. f) Suspension or revocation. Section 3. Severability. If any section, sentence, clause, or portion of this ordinance is for any reason held to be invalid or unconstitutional by any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions.
