CITY OF KOOTENAI  Resolution No. 2025-101  A RESOLUTION OF THE CITY OF KOOTENAI (THE CITY), A MUNICIPAL CORPORATION ESTABLISHED PURSUANT TO THE LAWS OF THE STATE OF IDAHO, UPDATING THE CITY FEE SCHEDULE.  WHEREAS, Idaho Code § 63-1311 grants city councils the ability to set and modify fees for services provided by the city; and   WHEREAS, pursuant to the aforementioned statute, the city has previously adopted fees for various services provided by the City; and  WHEREAS, periodic revisions to currently existing fees, or implementation of new fees may also be necessary from time to time; and  WHEREAS, Idaho Code § 63-1311A requires a public hearing on the establishment of any new fees and on fee increases greater than 5% of the fee last collected; and  WHEREAS, the City of Kootenai desires to update existing fees;   *****  THEREFORE, BE IT RESOLVED by the City Council and Mayor of the City of Kootenai, that the unified fee schedule for the City of Kootenai be amended as follows:     SECTION 1: ADOPTION OF UPDATED FEE SCHEDULE   The City Council adopts the updated City Fee Schedule, included and incorporated into this resolution as Exhibits A, B, C and C-1. This schedule may be further modified by resolution from time to time, or as needed.     SECTION 2: DIRECTIVE TO CITY STAFF  City staff shall be authorized to take all administrative actions necessary to implement and assess those fees for services established by the City.     SECTION 3: REPEAL OF PREVIOUS RESOLUTIONS  With the enactment of this resolution, the fee schedules adopted in Resolutions #90 and #93 are hereby updated, repealing said Resolutions and replacing them with those fees outlined in Exhibit A, B, C and C-1.    SECTION 4: SUPERCESSION OF PREVIOUS FEES  Any fee designated in any other resolution which is inconsistent with the provisions of this Resolution is hereby repealed or superseded to the extent of such inconsistency.    SECTION 5: EFFECTIVE DATE  This Resolution and revised fee schedule shall take effect immediately upon adoption and approval by the City Council and Mayor and remain in effect until amended or revised by subsequent action of the City Council.     SECTION 6: PRIOR BILLING AND PAYMENT OF PROCESSING FEES  Anyone requesting services from the City which are subject to assessed fees may be required to prepay for such services. In such instances, an invoice shall be sent to the requestor prior to the performance or production of services. If such invoice is noted to be an estimate for the cost of services, which final amount may be unknown until all services have been provided, the City may still require prepayment of such estimated costs. In such instance, any unused fees shall be refunded to the requestor.
