Polson man accused of firearm possession, bear-spray attack

A Polson man, already on probation for three counts of assault with a weapon, is facing new charges. Izayus Kai Jordan Prewett, 19, entered a plea of not guilty in District Court in Polson on Sept. 4 to two felony charges. They include unlawful possession of a firearm by a convicted person and failure to register as a violent offender, and two misdemeanor charges of assault.
According to court records, on Aug. 9, Polson Police were dispatched to a report that three men had been hit with bear spray at Sacajawea Park. The men told officers they saw Prewett and another person in a green Subaru parked in a handicap parking space.
One of the men recognized Prewett as someone who had allegedly assaulted a family member on an earlier date. When the men walked by, words were exchanged and Prewett allegedly threatened to fight them one on one. Instead, he allegedly pulled out a can of bear spray and deployed it at all three men and fled.
The men had to be treated at a hospital for skin and eye irritation. One of them told police that he could see a firearm in Prewett’s waistband.
Police located Prewett later and arrested him. A search of the green Subaru turned up a 9mm handgun, a magazine for it containing 11 rounds of ammunition and one can of bear spray.
Prewett was sentenced in District Court in Polson by Flathead County Judge Amy Eddy on May 2, 2024, to six years with the Montana Department of Corrections on each of three counts of assault with a weapon. Those sentences ran concurrently to each other.
Judge John A. Mercer set a trial date of Jan. 12. Prewett remains in custody with bond totaling $125,000.
