A Libby man is facing two felony charges after he allegedly assaulted a woman in a heavily wooded area west of Libby following a recent chase from a residence they shared.
Adam Gene Hartsock, 35, is accused of felony criminal endangerment and partner or family member assault, causing bodily injury, third offense. He is also accused of unlawful restraint, a misdemeanor.
Hartsock is lodged in the Lincoln County Detention Center on $100,000. He is scheduled to appear Wednesday, April 15, in front of Justice Court Judge Jay Sheffield.
According to the probable cause statement by county deputy Joshua Brabo, dispatch notified him about a possible assault at about 7 p.m. Tuesday, March 31, at a trailer court on Three Corner Road.
The alleged victim was reportedly suicidal and left the home in her vehicle at a high rate of speed. Hartsock, who is in a active, intimate relationship and has children with the woman, then followed the woman in his vehicle.
Many witnesses said they saw two vehicles speeding west on U.S. 2. They also reported the vehicles were, "all over the road," causing risk to other drivers. Brabo caught up with them on Cedar Creek Road, 1.7 miles from the junction of U.S. 2. He reported seeing Hartsock assault the woman using his hands on and around her face, mouth and throat area.
Hartsock allegedly told Brabo he was trying to remove prescription medicine from her mouth in an effort to prevent her from intentionally overdosing. Brabo said no such meds were found in the woman's mouth or near the scene. He also said after further investigation that the report of the woman being suicidal was unfounded. The alleged victim said she fled from Hartsock at their shared residence and he tried to run her vehicle off the road while traveling at speeds in excess of 80 mph.
She also told the officer she feared for her life and she chose the wooded area in attempt to escape him. She also said Hartsock struck her in the stomach and forcibly shoved his hand down her throat in an attempt to induce a vomit reflex. She also pointed out a number of bruises on her legs that were the result of the current and recent, prior incidents.
Brabo reported that Hartsock allegedly admitted to chasing the woman and putting her and other motorists at risk.
According to previous stories in The Western News, Hartsock has faced charges for assaulting a partner or family member, criminal distribution of dangerous drugs. There were also charges in 2020 for partner or family member assault.
A conviction for criminal endangerment could result in a maximum sentence of 10 years in the Montana State Prison. A conviction for PFMA could result in a 5-year term. A conviction for unlawful restraint may result in a six-month county jail term.
