NOTICE OF PUBLIC HEARING NOTICE IS HEREBY GIVEN that the Bonner County Commissioners will hold a public hearing at 1:00 PM on Wednesday, September 9, 2026, in the Bonner County Administration Building, 1500 Highway 2, Sandpoint, Idaho, by Zoom teleconference, and YouTube Livestream to consider the following request: File VS0001-26 – Vacation Title 50 – Vacation of Private Easement: Request to vacate and rededicate a 60’ public utility and fire easement, replacing it with a 25’ wide HOA-maintained fire access, public pedestrian path, and utility easement. The easement is located within lot 11 of Providence Subdivision. The project site is located off Safari Tracker Drive in Section 1, Township 57 North Range 2 West, Boise-Meridian. CITY OF CLARK FORK, IDAHO SUMMARY OF ORDINANCE #303 REPEALING ORDINANCES 193, 279, AND 287 AND ADOPTING AN UPDATED ZONING ORDINANCE CLARK FORK CITY CODE SUMMARY: The City of Clark Fork adopted Ordinance # 303 on August 10, 2026, repealing Clark Fork ordinances 193 (Building Code), 279 (Zoning), and 287 (Amendment to Ordinance 279) and adopting Ordinance #303 to: Repeal existing zoning and building codes and replace with an updated zoning ordinance that: Revises the definitions of setback and structure and removes the definition of setback line; clarifies uses allowed in the Highway Commercial zone; clarifies in the uses table prohibited uses; permits city-owned facilities and structures in all zones; revises dimensional standards to remove street frontage requirements, establishes maximum height not to exceed 30 feet and removes reference to two stories; specifies that zero setback is only permitted in the commercial zones for common walls; adds exceptions for construction across combined properties and for minor variations to standards; creates recreational vehicle occupancy and storage standards; corrects conditional use permit standards and minor grammatical errors; updates site plan permit procedures and penalties; and provides for severability; repeal of ordinances in conflict, and an effective date and publication thereof. The ordinance provides a new penalty section for site plan permit violations to read as: Penalties and remedies. Any person or entity who fails to comply with the regulations of this section shall be subject to the following penalties: A first offense shall be deemed an infraction, as established by Idaho Code, with a penalty not exceeding $300. Punishment and remedies for a second or any subsequent offenses shall be in accord with the provisions of Section 17.0, Violations and Penalties. Each day or portion of a day for which a violation continues shall be considered a separate offense. Civil Remedies: Nothing contained in this ordinance shall preclude the city from pursuing enforcement through injunctive relief, fees as established by resolution to recover costs of enforcement, or other civil remedies. Section 17.0 penalties remain as: Failure to comply with the provisions of this ordinance, unless stated otherwise in the respective section, shall constitute a misdemeanor. Each day such violation exists may be considered a separate offense, subject to the penalty of a fine of $1,000.00 dollars and not more than six (6) months incarceration in the County Jail, or both such fine and imprisonment. In addition to the criminal penalties above, the City of Clark Fork may proceed against the violator by initiating civil legal action in a court of competent jurisdiction. In the event the City prevails, the violator shall be responsible for all costs including a reasonable sum for attorney’s fees.
