SUMMARY OF SPIRIT LAKE ORDINANCE NO. 635 AN ORDINANCE OF THE CITY OF SPIRIT LAKE, A CITY IN KOOTENAI COUNTY, STATE OF IDAHO, AMENDING TITLE 5 OF THE CITY CODE OF THE CITY OF SPIRIT LAKE, REPEALING THEREFROM SECTION 4 OF CHAPTER 2, TITLED “DEPOSIT OF SNOW, ICE, ROCKS OR DEBRIS;” ALSO AMENDING TITLE 6 OF THE CITY CODE, ADDING THERETO A NEW CHAPTER, CHAPTER 3, TITLED “SNOW REMOVAL,” PROVIDING FOR PROHIBITED ACTIVITIES DURING SNOW EVENTS, PROVIDING FOR CITY CITATION PENALTIES, AS ESTABLISHED BY CITY COUNCIL RESOLUTION, OF ONE HUNDRED DOLLARS ($100.00) FOR A FIRST VIOLATION, TWO HUNDRED DOLLARS ($200.00) FOR A SECOND VIOLATION, AND ONE THOUSAND DOLLARS ($1,000.00) FOR A THIRD VIOLATION DURING THE SAME SNOW SEASON, WITH CITATIONS DOUBLING IF NOT PAID BY THE DUE DATE, AND PROVIDING FOR POSSIBLE MISDEMEANOR ENFORCEMENT FOR REPEATED VIOLATIONS OR UNPAID CITATIONS; PROVIDING THAT THE REMAINING SECTIONS OF SPIRIT LAKE CITY CODE SHALL REMAIN IN EFFECT; PROVIDING FOR SEVERABILITY; PROVIDING FOR THIS ORDINANCE TO BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, APPROVAL, AND PUBLICATION ACCORDING TO LAW. THE PURPOSE OF SAID AMENDMENTS IS TO PROVIDE FOR PUBLIC HEALTH, SAFETY, AND WELFARE BY ENSURING THE ORDERLY REMOVAL OF FALLEN SNOW FROM ROADS, RIGHTS-OF-WAY, AND SIDEWALKS WITHIN THE CITY AND PROVIDING A MEANS OF ENFORCING THE SAME.
