NOTICE OF PUBLIC HEARING LAKE COUNTY BOARD OF HEALTH The Lake County Board of Health hereby gives notice that Bruce Jones and Jacqueline McLean Jones, owners of Tract 9 on Certificate of Survey No. 5949 in Section 10, Township 23 North, Range 19 West P.M.M., are requesting a variance from requirements contained in the Administrative Rules of Montana Sub-Chapter 9, Subdivisions/On-Site Subsurface Wastewater Treatment Systems, which are adopted by reference in the Lake County Wastewater Treatment System Regulations. The property owners submitted a wastewater treatment system permit application to connect an additional one-bedroom living unit to the existing septic system, thereby increasing the design flow. A variance was granted in 2002 to allow the drainfield to be located less than 100 feet from Station Creek to serve the existing single living unit. The current variance request is to allow a second living unit and to expand the existing septic system, which would result in the drainfield being located approximately 81 feet from Station Creek. You may also email your comments to [email protected] RESOLUTION NUMBER 26-08 A Resolution of Intent to Revise Lake County Solid Waste Fees WHEREAS, Lake County Solid Waste Board has submitted for consideration by the Commission a proposed revised schedule of fees applicable to activities in that department, attached hereto as Exhibit A; and, WHEREAS, the said recommendation by the Solid Waste Board reflects several different options for fee structures, including three different options from the Board itself and including a recommendation of the Director thereof; and, WHEREAS, Lake County Board of County Commissioners is empowered to amend and update it’s Solid Waste fee schedule as may be necessary from time to time, all pursuant to Section 7-1-2101(2); and, WHEREAS, for good cause shown, the Board of County Commissioners intends to implement one of the recommended fee schedules shown on Exhibit A hereto, or some combination of them; and, WHEREAS, this Resolution of Intent, together with a copy of the proposed fee schedule, shall be available to any interested party at the office of the Commission, shall be published pursuant to 7-1-2121, Montana Codes, and the Commission shall then thereafter shall hold public hearing no earlier than 30 or later than 90 days after passage of this Resolution of Intent; and, WHEREAS, prior to and at such public hearing, the Board shall accept written or verbal protests or comments and shall receive general protests and comments relating to the establishment of the revised planning office fee schedule in Exhibit A hereto, or any other matter relating to the proposed fee schedule revision, and, based on testimony received in the public hearing, the Commission in a later resolution may establish a different fee schedule than proposed, or change the kinds, types, or levels of service and associated fees. NOW, THEREFORE, BE IT RESOLVED: That notice shall be published pursuant to Section 7-1-2121, Montana Codes, of the public hearing on the within Resolution of Intent to be held on the 9th day of March, 2026, at 3:00 pm, in the Commissioners Chamber at 106 4th Avenue East, Polson, MT 59860 upon which hearing, based on testimony received in the public hearing, the Board of County Commissioners may in a later resolution adopting such revised Solid Waste fee schedule, establish a different fee schedule than proposed, change the kinds, types, or levels of associated services, or of the associated fees. Barron, Chairman Steve Stanley, Member Gale Decker, Chairman Attest: Kendra Steele, Clerk & Recorder Exhibit A: Proposal • MSW Municipal Solid Waste tipping fees for commercial haulers to be set at $37.00/ton upon passage of final resolution. • CD Construction Demolition tipping fees at the landfill should be set at $56.00/ton upon passage of final resolution. • Beginning Tax Year 2026 there will be an annual CPI increase not to exceed 3%. This increase will include all fees associated with Solid Waste, and the annual solid waste fee currently set at $180.00. These CIP increases will continue for three years and then be re- evaluated. • Brush rates will increase to include a $10.00 minimum fee and $40.00/ton.
