The sale is a public sale and any person, including the Beneficiary, may bid at the sale. The bid price must be paid immediately upon the close of bidding by certified funds (valid money orders, certified checks or cashier’s checks). In the event that all defaults are cured the foreclosure will be dismissed and the foreclosure sale will be canceled. The scheduled Trustee’s Sale may be postponed by public proclamation up to 30 days for any reason. If the Trustee is unable to convey title for any reason, the successful bidder’s sole and exclusive remedy shall be the return of monies paid to the Successor Trustee and the successful bidder shall have no further recourse. SUMMARY OF SPIRIT LAKE ORDINANCE NO. 644 AN ORDINANCE OF THE CITY OF SPIRIT LAKE, KOOTENAI COUNTY, IDAHO, VACATING A CERTAIN PUBLIC RIGHT-OF-WAY LOCATED WITHIN THE CITY OF SPIRIT LAKE, KOOTENAI COUNTY, IDAHO; PROVIDING FOR THE RECORDING OF THIS ORDINANCE; AND PROVIDING AN EFFECTIVE DATE. Section 1 provides the legal description. Section 2 provides that, upon passage and approval, the vacated right-of-way shall revert to adjoining property owners as provided by law, subject to existing easements and utilities. Section 3 directs the City Clerk to record the ordinance with the Kootenai County Recorder pursuant to Idaho Code § 50-311. Sections 4 and 5 provide for severability and establish the effective date upon passage, approval, and publication according to law.
