By submitting a bid, the Bidder agrees to comply with the provisions of all Tribal ordinances and laws. In accordance with the Tribe’s TERO Ordinance, the Contractor shall give preference to the employment of Indians and shall also meet subcontracting requirements relating to local, Indian-owned firms. Subject to the requirements of Indian preference, the contractor must ensure that employees and applicants for employment are not discriminated against because of their race, color, religion, sex or national origin. Owner hereby specifically reserves and retains its sovereign immunity status and all rights and privileges pertaining thereto. Any mediation or other dispute resolution award against the Owner must be brought in Tribal court. The Contractor will be required to pay not less than the minimum wage rates of the general wage decision for the project, as set out in the bid proposal. Such rates will be made a part of the contract covering the project. The Fair Labor Standards Act of 1938 (U.S.C.A. Title 29, Paragraphs 201-219, Chapter 8) shall apply in the employment of labor for this project. The right is reserved to reject all proposals, or to accept the bid proposal deemed best for the Coeur d’ Alene Tribe. No bid will be considered unless accompanied by an acceptable proposal guaranty.
