An alleged drunken fight on Memorial Day at Happy’s Inn between two brothers shooting at each other left one seeking treatment and the other behind bars.

Libby resident Erick Stanley Boothman, 26, is facing two felony charges, assault with a weapon and criminal endangerment. Boothman’s arraignment is scheduled for Monday, June 15, in Lincoln County District Court.

His bail was first set at $50,000 before a reduction to $10,000 was granted on June 4. Court records indicate Boothman was still in custody as of June 10.

In the court document charging the offense, county sheriff deputy Joshua Brabo was patrolling on Memorial Day evening in Troy when dispatch reported the incident. The defendant called to report the incident and said he and his brother, both reportedly drunk, exchanged gunfire on the ACM Road. Boothman said he wasn’t sure if his brother was shot.

During an on-scene interview, the accused allegedly admitted he fired multiple rounds from a .44 caliber revolver toward his brother. Deputy Brabo collected the gun from the man’s truck after he gave his consent.

According to the deputy’s statement, Erick’s brother allegedly fired one round during the gun battle. A bullet hole was found in Boothman’s vehicle. His brother fled to Marion, was detained by Flathead County deputies before being released to receive treatment for injuries he sustained prior to the shooting.

The alleged victim told Flathead Co. investigators he shot at his brother after he shot at him, then tried to run him over with a vehicle.

A conviction for assault with a weapon may result in a 20-year sentence in the Montana State Prison. For criminal endangerment, the maximum term is 10 years.
