A former tenant arrested after allegedly shooting at his landlord during eviction proceedings in Flathead County in 2024 took a deferred prosecution agreement earlier this year.
Joshua Duwayne Stice, 41, of no fixed address, was brought up on a felony count of assault with a weapon in Flathead County District Court following his Dec. 3, 2024, arrest north of Kalispell. Arraigned before then Judge Robert Allison three days later, Stice maintained his innocence.
Stice entered into a deferred prosecution agreement on March 11 of this year. Under the terms of the deal, Stice must remain law abiding for one year or risk seeing the charge brought back against him.
Prosecutors filed a motion to dismiss that same day. Judge Paul Sullivan, who took over the case following Allison's retirement, ordered it dismissed without prejudice on March 12.
Prior to Stice's arrest, his then landlord told responding Flathead County Sheriff's Office deputies that she heard several gunshots ring out from Stice's former McDermott Lane home about 5:05 a.m. Glancing out her kitchen window, she saw Stice aiming a rifle at her, court documents said.
Deputies arrested Stice at the property and searched his Ford Escape. They found two loaded firearms, including an AR-style rifle, inside the vehicle, according to court documents.
