NO. 31951 RESOLUTION OF INTENT A RESOLUTION OF INTENT TO INCREASE THE FLATHEAD COUNIY WATER & SEWER DISTRICT #8, HAPPY VALLEY WATER RATES AND CHARGES TO BECOME EFFECTIVE June 1, 2026 AND SET A DATE AND TIME FOR A PUBLIC HEARINGS. Whereas, the water rates and charges that are in effect at the present time are not adequate to provide revenues to defray the costs of operation, maintenance, and capitol of the distribution Facilities and Systems for the Flathead County Water & Sewer District #8, Happy Valley. Whereas, the water rates were reviewed to insure that charges are reasonable and just by the Flathead County Water & Sewer District #8, Happy Valley Board of Directors. Whereas, the provision of the water systems and facilities is essential to the preservation of the public health and welfare and that the new rate must, before taking effect, be approved by the Board of the Flathead County Water & Sewer District #8, Happy Valley after advertising and conducting a public hearing pursuant to the rules and regulations (MCA 7-13-2275). Whereas, the current budgetary requirements with respect to the operation of said facilities, in addition to a proposed $2.00 per month per customer fee for the meter replacement program. The meters have reached their average expected life span and the system will begin replacing meters as the meters fail. The rates will become effective on June 1, 2026 , if the board of directors approves the increase in rates at the public hearing and business meeting on April 20, 2026. Whereas, pursuant to Montana Law (MCA 7-13-2275(6)(a), the Flathead County Water & Sewer District #8, Happy Valley board of directors have determined that a public meeting must be advertised and held to gather public testimony and input regarding the proposed increase in water rates and charges. NOW, THEREFORE, BE IT RESOLVED BY THE Flathead County Water & Sewer District #8, Happy valley BOARD OF DIRECTORS: 1. That the board of directors considers it both advisable and necessary to increase the municipal water rates for alt users and proposes to increase the rates and charges per the following: 2. A 5% increase will raise our base rate to $31.59 and per thousand gallon thereafter is $2.16, The new Meter Replacement Fee would add $2.00 fee for each user every month. IT would remain the same fee in a specific account. The meters would be replaced as they failed to work. That a public hearing will be held on April 20, 2026 at 7:00 P.M. at 103 Bear Trail, Whitefish, MT 59937. The public hearing will be held and will be followed by a board discussion and a vote on the proposed water rate increase. 2. Notice of the hearing shall be posted in conformance with MCA 7-1-2121 or MCA 69-7-111 in a local newspaper between fourteen (14) and twenty-one (21) days prior to the hearing. 3.
