Coeur d’Alene man pleads guilty to rape

BONNERS FERRY — A Coeur d’Alene man has entered a guilty plea for two charges related to sexual abuse. 

As part of a pretrial settlement, Scott Smith, 49, pled guilty to one count of lewd conduct with a minor under 16 and one count of rape when the victim is under 18. 

Initially, Smith was charged with three counts of rape and one count of lewd conduct, but two rape charges were dropped as part of the plea deal. 

He will be sentenced on May 20 in Boundary County court on the two felonies. Smith’s punishment will be partially based on a completed psychosexual evaluation that examines his sexual behavior, history, attitudes, behaviors and risk factors. 

If the PSE identifies Smith as “low risk”, the state and defendant agree to a prison sentence of five years determinate, followed by ten years indeterminate. Smith is expected to argue for probation and the state will argue for a retained jurisdiction. 

Retained jurisdiction, commonly known as a rider, is available as a sentencing option to judges in Idaho. Individuals sentenced to a rider remain in an Idaho Department of Corrections facility but remain under the judge's jurisdiction while they receive necessary treatment and participate in required programs. A successful completion of a rider can result in supervised probation. If someone does not complete a rider, they may be sentenced to prison.    

Regardless of the outcome of the PSE, Smith is expected to request a retained jurisdiction, where the underlying sentence may vary depending on his risk factor.
