NOTICE OF TRUSTEE’S SALE TO BE SOLD FOR CASH AT TRUSTEE’S SALE on September 1, 2026, at 10:00 o’clock A.M. (recognized local time) at the South Door of the Lincoln County Courthouse, located at, 512 California Ave, Libby, MT 59923, the following described real property, situated in Lincoln County, Montana: That part of the S½SW¼SE¼ and the SW¼SW¼SE¼SE¼ in Section 31, Township 29 North, Range 30 West, P.M.M., Lincoln County, Montana, lying West of US Highway 2.  Commonly known as: 131 Libby Creek Cut Off Road, Libby, MT 59923 Parcel No. 56310  Kevin Russell Hayworth and Jennifer D. Lepsik, as Grantor(s), conveyed said real property to Flying S Title and Escrow of Montana, Inc., as Trustee, to secure an obligation owed to Albert Ross Purviance and Deidra Ann  Purviance, as Beneficiary, by Montana Trust Indenture dated October 18, 2023, and recorded October 18, 2023, as Document No. 307927 Book 403 Page 488. The Beneficial interest is currently held by Albert Ross Purviance  and Deidra Ann Purviance. Kevin Russell Hayworth and Jennifer D. Lepsik have defaulted in the performance of said Montana Trust Indenture by failing to 1) comply with section 2 of said Montana Trust Indenture to provide, maintain and deliver to Beneficiaries, insurance of such type or types and amounts as Beneficiaries may require. 2) comply with section 4 of said Montana Trust Indenture to pay before delinquent all taxes and assessments.3) make the monthly payment of $805.23 plus an escrow fee of $3.00 for a total monthly payment of $808.23 due for the 18th day of  February, 2026 and a like sum of $808.23 due for the 18th day of each and every month thereafter., which monthly installments would have been applied on the principal and interest due on said obligation, and other  charges against the property or loan. As of April 14, 2026 there is due and owing on the loan an unpaid principal balance of $143,910.03, accrued interest in the amount of $1,738.91 plus late fees in the amount of $161.04, for a total amount due of $145,809.98. Interest accrues on the Note at the rate of 5% per annum with a per diem rate of $19.99 after April 14, 2026. Interest continues to accrue. All delinquencies are now due together with any late charges, advances to protect the security, and fees and costs associated with this foreclosure.  The Beneficiary anticipates and may disperse such amounts as may be required to preserve and protect the property and for real property taxes that may become due or delinquent, unless such amounts of taxes are paid  by the Grantors. If such amounts are paid by the Beneficiary, the amounts or taxes will be added to the obligation secured by the Montana Trust Indenture. Other expenses to be charged against the proceeds of this  sale include the Trustee’s fees and attorney’s fees, costs and expenses of the sale, and late charges, if any.  Beneficiary has elected and has directed the Trustee to sell the above described property to satisfy the obligation. The sale is a public sale and any person, including the Beneficiary, excepting only the Trustee, may bid at the sale. The bid price must be paid in cash at the time of sale. The conveyance will be made by Trustee’s Deed.
