A man accused of leveling a gun at an inhabitant of a Kalispell homeless shelter in late winter took a deferred prosecution agreement in September.
Prosecutors brought Clint Dahl Dodge, 59, up on a felony charge of assault with a weapon following the alleged Feb. 24 confrontation on Second Street West. He pleaded not guilty at his March 12 arraignment in Flathead County District Court but inked the agreement with prosecutors on Sept. 24.
The deal requires Dodge to remain law-abiding for two years, eschew firearms, and avoid the shelter and the victim in the case. Upon Dodge's successful completion of the two-year stretch, prosecutors will forfeit their ability to prosecute him on the felony charge.
The same day Dodge signed the agreement, prosecutors filed a motion to dismiss the case without prejudice. Judge Danni Coffman agreed to the request on Oct. 6.
Dodge was a neighbor of the homeless shelter when he allegedly approached the victim, addressed him with a racial slur and pointed a handgun at him, according to court documents. The victim later retreated to the shelter and dialed 911.
Arriving Kalispell Police officers found Dodge at his 900 block Second Street West home and ordered him to come out, court documents said. Dodge, who emerged from the house wearing an empty leather holster on his belt, allegedly admitted to confronting the victim over his music but said he never pointed a weapon at the man.
A search of Dodge's home turned up a black 9 mm semiautomatic pistol, court documents said.
According to the arresting officer, whose account of the incident was filed in district court, Dodge had a history with the victim, including allegations of threats and disorderly conduct. The officer recalled speaking to Dodge in the past and counseling him.
