PROPOSED CHANGES Idaho Medicaid intends to submit Medicaid and Children’s Health Insurance Program (CHIP) State Plan Amendments (SPAs) to the Centers for Medicare and Medicaid Services (CMS) to address Section 5112 of the Consolidated Appropriations Act (CAA, 2023), which requires that states submit SPAs attesting that they provide twelve (12) months of continuous eligibility (CE) for children under the age of nineteen (19). See also CMS State Health Official Letter SHO 23-004 Section 5112 Requirement for all States to Provide Continuous Eligibility to Children in Medicaid and CHIP under the Consolidated Appropriations Act, 2023. Idaho is already functionally compliant, as it has had this previously optional children’s coverage in place since 2006. See Idaho state administrative code IDAPA 16.03.01.524 Continuous Health Care Assistance Eligibility For Children Under Age Nineteen. That language was added to state administrative code via a Temporary and Proposed rule in 2006 (see Idaho Administrative Bulletin Vol 06-8) under a complete chapter rewrite driven by Idaho House Bill H0776 Idaho Medicaid Simplification Act (2006), Idaho Senate Bill S1417 Medical assistance, eligible child (2006), and Idaho HCR050 Medicaid participant, cost-sharing (2006). The new rule section Continuous Health Care Assistance Eligibility For Children Under Age Nineteen was effective July 1, 2006, which is the date the state effectively operationalized/implemented that change for Medicaid children’s eligibility. The Department intends to submit this amendment to CMS with a requested effective date of October 1, 2026.
