A Kalispell motorist caught allegedly driving drunk with his pregnant wife and four children in his truck on Independence Day is now facing a felony case in Flathead County District.

Andrew Todd Westfall, 34, is expected to be arraigned on a single count of criminal child endangerment before Judge Dan Wilson on Nov. 5. If convicted, he could serve up to 10 years behind bars and pay a fine of up to $50,000.  

A Montana Highway Patrol trooper pulled Westfall over near mile marker 137 of U.S. 2 after allegedly catching him speeding and watching as loose trash flew out of his truck's bed. While speaking with Westfall, the trooper described detecting the strong smell of alcohol inside the cab of the truck, according to court documents.   

Unable to find his driver's license in his cab, Westfall hopped out in the hopes of finding it in the bed of the truck, court documents said. While he searched for it, the trooper spotted several open alcoholic beverage containers, court documents alleged.  

The trooper had Westfall sit in her patrol car after his attempts to find his license proved fruitless. As she located his information on her computer, she described her vehicle filling with "the odor of an ingested alcoholic beverage," court documents said.  

"I definitely have had a couple beers, I'm not gonna lie to you," Westfall allegedly said when asked how much he had to drink that night.  

He later admitted to using marijuana roughly eight hours earlier, court documents said.  

A cooperative and remorseful Westfall agreed to undergo a breath test, which returned at 0.165, according to court documents. He was taken to a medical facility in Whitefish for a blood draw, which was sent to the Montana State Crime Lab, before landing in county jail. 

An analysis of Westfall's blood determined he had an alcohol content of 0.157 and THC in his system, though at a concentration below the legal limit, court documents said.
