Guest opinion: Obligation to report questionable activity in Whitefish Lake
Toby Scott | Whitefish Pilot | UPDATED 1 month, 3 weeks AGO
Flathead County has about 269 lakes; each is different, and their lakeshore regulations have no provision for unique lake circumstances. One such situation is that Whitefish Lake and its lakeshore regulations are specific to that lake and the city requires a permit to do anything within the lakeshore protection zone (20' above high water level) and a permit to build on the lake anywhere within the city limits. However, the city of Whitefish only has jurisdiction over the part of the lake within city limits. Outside of those limits, it is up to the county to enforce any regulations that might be violated, but they don't have the staff for overwatch or enforcement. The county will follow up if a complaint or report is filed informing them of a potential problem or violation.
Whitefish city staff and the Lakeshore Protection Committee are willing to address issues brought forth to the county or city, if informed. Attempts to create an interlocal agreement between the city and the county to allow Whitefish the administration and jurisdiction over the entire lakeshore have been ignored by the county commissioners. Pending any time in the future that Whitefish would have control over all construction around the lake, it is up to the citizens and residents of Whitefish Lake to report any oddities in construction or questionable activities around the Lake.
