A judge has dismissed the felony charge against a man arrested in Kalispell last month during a disturbance that involved the regional SWAT team.
Prosecutors charged 88-year-old Roger Allen Grilley with assault with a weapon following the Aug. 19 incident on the 500 block of 10th Street West. In the charging documents, they accused Grilley of menacing several people with three knives.
An arraignment was scheduled for Sept. 10, but prosecutors filed a motion to dismiss the case "in the interest of justice" on Aug. 26. Judge Paul Sullivan ordered it dismissed on Sept. 8.
The disturbance and subsequent law enforcement response prompted Kalispell Police officials to issue a news release late in the evening of Aug. 19.
