A Kila man was sentenced to 40 years in Montana State Prison, with 30 years suspended, for one count of felony sexual assault.
Noah Laverne Powell, 32, admitted to assaulting a 13-year-old girl in October 2014.
Flathead District Judge Robert Allison said the sentence is appropriate, considering it was Powell’s second sexual offense. Powell also was designated a Level 2 sex offender, meaning the risk of a repeat sexual offense is moderate.
As part of a plea agreement, the charge had been amended from sexual intercourse without consent. A second charge of sexual intercourse without consent was also dropped as part of the plea agreement. Powell had been accused of assaulting another underage girl.
Powell was given credit for 228 days already served at Flathead County Detention Center and a parole requirement to complete a sexual offender treatment program.
