Homeless shelter resident accused of raping roommate

A man staying at a Kalispell homeless shelter faces a rape charge after allegedly sexually assaulting a roommate early Sunday morning.
Prosecutors filed one count of felony sexual intercourse without consent against Christopher John Boer, 39, in Flathead County District Court following his July 30 arrest. His arraignment is not yet scheduled.
The victim told arriving Kalispell Police officers that he was sharing a room at The Samaritan House with Boer and another man, according to court documents. He fell asleep about 10:30 p.m., July 29 and awoke to allegedly find Boer’s genitals in his mouth.
The victim recounted shoving Boer away and fighting with him, according to court documents. Stopping after he realized Boer wasn’t fighting back, the victim left the room and headed to the shelter’s security office, court documents said.
Officers reported finding a nude Boer on the corner of Eighth Avenue West and Second Street. Behaving erratically, Boer sported injuries to his face, court documents said.
Suspecting drug use, authorities took Boer to Logan Health for an evaluation. Doctors and mental health professionals later cleared him, court documents said.
Boer later allegedly told investigators that he was nude when he approached the victim. He also admitted putting his genitals in the victim’s mouth, saying that he thought the victim was awake at the time, court documents said.
Sexual intercourse without consent carries a maximum penalty of 20 years in Montana State Prison and a $50,000 fine.
