Man agrees to leave Montana forever as part of deferred prosecution agreement

A man accused of threatening the police officer who arrested him for allegedly urinating behind a Whitefish bus stop last year later received a suspended jail sentence and agreed to leave Montana forever.

Prosecutors brought 53-year-old Dustin Lawrence Oswald, formerly of Whitefish, up on a felony count of threats or improper influence in official or political matters following his March 12, 2025 arrest near the intersection of Baker Avenue and 13th Street. He pleaded not guilty at his April 3 arraignment before Judge Heidi Ulbricht in Flathead County District Court.  

But by April 23, Oswald had reached a multi-faceted deal with prosecutors. For the felony charge, Oswald inked a deferred prosecution agreement that, among other stipulations, required him to leave Montana the following day and never return.  

As part of the package, prosecutors filed a second charge, misdemeanor obstructing a peace officer, with a plea deal already in place. That agreement called for a suspended six-month jail sentence in exchange for Oswald admitting guilt.   

Ulbricht stuck to the terms of the arrangement at Oswald's sentencing. She gave him credit for 41 days of time served and ordered him to pay $185 in fines and fees.  

Oswald was described in court documents as growing upset after a Whitefish Police officer confronted him for allegedly peeing about 3:07 p.m. Initially arrested for disorderly conduct, Oswald allegedly threatened to tear the officer's throat out.  

"I'm going to [expletive] tear your face off, bro," he allegedly told the officer. "I'm going to bust your nose right across your [expletive] face, bro, [expletive] you up."
