A homeless man accused of pulling a knife on restaurant workers in Kalispell last year later received a deferred prosecution agreement.
Prosecutors brought Markus James Meyers, 19, up on a felony count of assault with a weapon in Flathead County District following his March 21, 2025, arrest. He pleaded not guilty before Judge Amy Eddy the following month and accepted the deferred prosecution agreement in August.
Under the terms of the deal, Meyers must remain law-abiding for two years, forgo owning weapons — to include knives — and undergo a mental health evaluation and follow any treatment recommendations. Meyers must also stay 400 feet away from the U.S. 2 restaurant at all times.
Eddy ordered the case dismissed without prejudice Aug. 15.
Meyers' confrontation with the restaurant's staff began after they discovered him in the business's bathrooms, according to court documents. Meyers previously had been barred from the premises.
Meyers struggled with the two employees tasked with escorting him out, prompting the bar manager to pick him up, carry him outside and deposit him on the ground. Meyers pulled out the knife, but several employees held him down while a coworker called the authorities, court documents said.
Released by the employees, Meyers departed before Kalispell Police officers arrived at the restaurant about 9:30 p.m. But they caught up with him near another restaurant not long after, court documents said.
Officers described Meyers as wearing a chest armor vest carrier with an inserted front plate. A fixed blade knife was attached to the front of the vest, according to court documents.
Meyers allegedly admitted to pulling the knife and told investigators he regretted being unable to use it.
