WALLACE — A Kellogg man is facing a felony rape charge in connection with an alleged assault reported Saturday in Kellogg.

Damian Reed, 19, was arrested Oct. 11 after Kellogg Police Department officers were notified of an alleged assault that reportedly occurred late Saturday night.

According to court documents, the alleged victim told police she met Reed, whom she described as a longtime friend, at Kellogg City Park before the two walked to Reed's residence.

According to a probable cause affidavit, the victim told investigators they later went to a bedroom in the basement of the home. She said Reed began kissing her as she attempted to change clothes and, despite her objections and efforts to push him away, engaged in sexual intercourse without her consent and used force to restrain her.

KPD Officer Jeremy Ross later contacted Reed at the residence.

According to Ross, Reed initially denied kissing or touching the victim but later told police the two had engaged in consensual sexual intercourse. Reed told investigators the pair had been flirting, kissing and spending time together before having sex. He also reportedly acknowledged holding the woman's hands down during the encounter.

After reviewing both statements, Ross wrote that he believed it was more likely than not that Reed committed rape by engaging in sexual intercourse while overcoming the woman's resistance by force. Reed was subsequently taken into custody.

Ross later met with Reed in the booking area of the Shoshone County Jail, where the two discussed a series of text messages between Reed and the victim. During his initial statement, Reed reportedly told Ross that he and the victim had exchanged flirtatious messages.

Reed gave Ross permission to review his phone, and the officer documented the messages in his report.

"In the thread, I observed (redacted) telling Damian she wanted to pull his hair. Damian responded 'no' to having his hair pulled. (Redacted) responded by saying she would only pull his hair when they were alone. Damian agreed, saying no hair pulling until they were alone in his room. (Redacted) responded by saying she thought that was fair. There were some other text messages which may have been flirtatious in nature but lacked context."

On Tuesday, Reed made his first court appearance and was formally charged with rape where resistance was overcome by force or violence. The felony charge carries a potential sentence of one year to life in prison upon conviction.

Following his first appearance, Reed was released on his own recognizance. He is scheduled to appear in magistrate court at 8:30 a.m. Oct. 22.
