A man convicted of failing to pay child support in 2014 is back in Flathead County District Court after allegedly beating his daughter in Fortine and drinking alcohol.

Prosecutors with the Flathead County Attorney’s Office are seeking the revocation of 55-year-old Gary Matthew Montgomery’s suspended 10-year sentence with the state Department of Corrections in connection with the alleged violations, which occurred in January and June.

Montgomery is expected to appear before Judge Dan Wilson on the revocation proceedings on Aug. 6.

He remains in the county jail with bail set at $100,000.

Montgomery earned the original conviction after falling more than 29 months behind on his child support by November 2013, according to court documents. His ex-wife told the Kalispell Police Department that Montgomery also failed to help with his children’s medical bills.

Investigators believed that Montgomery owed about $61,809.

While prosecutors at the time opened a felony case against Montgomery for failing to support his children, they also sought to revoke a partially suspended 15-year sentence for a 2003 negligent homicide conviction. In September 2014, a district court judge gave Montgomery 10 years with the state Department of Corrections as a new sentence in the negligent homicide case and a suspended 10-year sentence in the child support case, ordering the two to run consecutively.

Montgomery finished serving his sentence on the negligent homicide conviction in September 2024 and began serving his second sentence immediately afterward, court documents said.

In June of this year, an agent with the state Division of Criminal Investigation asked to speak with Montgomery’s probation officer in Libby. Montgomery’s daughter died by suicide June 6, but newly surfaced video captured him assaulting her on Jan. 1 — months before her death, court documents said. In it, Montgomery is shown throwing her to the ground and punching her, according to court documents.

Montgomery also admitted drinking alcohol on June 7, according to court documents.

Probation and Parole Officer Steve Watson wrote in his violations report that Montgomery had previously drunk alcohol in March 2025 and used cocaine in May 2026.

Watson recommended that Montgomery receive a partially suspended 10-year sentence to the Department of Corrections if found in violation of the terms of his sentence.

“I would recommend a secure placement due to the serious nature of the violations listed above,” he wrote.
