Smith sentenced in sexual abuse case

BONNERS FERRY — A Coeur d’Alene man has been sentenced on May 20 to a retained jurisdiction with an underlying prison term of 15 years after accepting a plea agreement in a sexual abuse case.
Scott Smith, 49, was sentenced to five years fixed and 10 years indeterminate on one count of lewd conduct with a child under 16 and one count of rape involving a victim aged 16 or 17. The sentences are equal for both counts and will run concurrently.
Under a retained jurisdiction program, or rider, an inmate is incarcerated in an IDOC facility but is under the judge's jurisdiction to receive treatment and programming. Upon successful completion of the rider, a resident can be placed on probation. If unsuccessful, a judge can relinquish jurisdiction and sentence them to prison based on their behavior.
If Smith does not complete his rider, he will have to complete the underlying 15-year prison sentence.
Smith also will be required to register as a sex offender. He was ordered to pay $3,091 in court costs and fines, as well as $990 in restitution to the victim.
He received 34 days credit for time served.
Smith originally was charged with three counts of rape and one count of lewd conduct with a child. According to court records, a criminal complaint was filed on Nov. 6, 2025, with the alleged incidents occurring between 2015 and 2018.
Smith is being remanded to the custody of the Idaho Department of Correction.
